INTERPOL DIFFUSIONS AND RED NOTICES
The issuance of an international wanted notice, widely known as a Red Notice (or diffusion), is a relatively straightforward process available to all member countries of the organization. A formal request for extradition (Red Notice) as well as an informal request (diffusion) are the most common types of notices. However, INTERPOL’s rules strictly limit the issuance of such notices in cases involving political matters, war crimes, as well as private and administrative matters.

MISUSE OF INTERPOL RED NOTICES
Despite these restrictions, abuse of INTERPOL channels to target political opponents, business rivals, as well as individuals fleeing opaque or unfair law enforcement systems is quite common. Such misuse can cause significant personal and professional harm. Combating violations of the rules governing the use of INTERPOL notices has become one of INTERPOL’s key priorities today.
PROTECTION FOR REFUGEES AND ASYLUM SEEKERS
Individuals with a well-founded fear of persecution on national, racial, or religious grounds, as well as due to membership in a particular social group or political opinion, may apply for asylum. For such individuals, the existence of an INTERPOL notice can be particularly troubling. However, a special procedure for removing INTERPOL notices applies to asylum seekers and refugees. Where an extradition request is found to be unlawful or where there is a critical level of human rights violations, the notice is either suspended or deleted.

RED NOTICE
A Red Notice is an official publication in INTERPOL’s network requesting the arrest of a person for the purpose of extradition. The corresponding file already contains all the extradition materials, although countries typically request a formal extradition request to be submitted as well. A portion of such notices is published on INTERPOL’s official website, but these concern the most wanted individuals. The main body of notices is available to law enforcement agencies and border control authorities.

RISKS
DIFFUSION
Diffusions have exactly the same parameters as the corresponding notices. However, this type of communication is informal, and a red diffusion does not undergo a review by the General Secretariat to verify its compliance with INTERPOL’s rules for notices. As a result, the decision on whether to arrest the individual remains with the country concerned, although state authorities almost always respond to such requests in some manner.

CHALLENGE OF RED NOTICE OR DIFFUSION
PREVENTIVE (PRE-EMPTIVE) REQUEST
A notice for arrest and extradition can be challenged before the Commission for the Control of INTERPOL’s Files (CCF). The Commission has broad powers to review the criminal case for lack of merit, political motivation, or violations of fair trial standards.
REMOVAL OF OTHER FILES FROM INTERPOL DATABASES
National Bureaus of INTERPOL essentially function as departments of law enforcement agencies in the countries initiating the notice, with direct access to INTERPOL’s database. In addition to Red Notices, which require review by the General Secretariat, law enforcement authorities may issue other notices and diffusions that can also have adverse consequences, most widely used being Blue, Yellow, and Green Notices.

SOLUTIONS
A pre-emptive request is a mechanism that allows steps to be taken in advance to prevent the issuance of a diffusion or Red Notice. It serves as an effective safeguard, enabling the blocking of a potential notice and ensuring that the individual is informed if a National Bureau seeks to initiate such a request. INTERPOL will notify the person of the possible publication and provide an opportunity to present a defence while temporarily suspending the issuance of the notice.
